The minutes of a regular meeting of the Borough of Pine Hill, County of Camden , State of New Jersey , held on April 21, 2008 . The meeting was called to order by Mayor Costantino at 7:35pm , followed by the Pledge of Allegiance.

 

The clerk stated that the notice requirements provided for in the “Open Public Meetings Act” have been satisfied. Notice was properly given and transmitted to the Record Breeze, Blackwood, New Jersey and the Courier Post Newspaper, Cherry Hill, New Jersey, posted on the bulletin board in the Borough Hall and on file with the Borough Clerk of the Borough of Pine Hill all on January 8, 2008.

 

Mayor Costantino addressed the residents in attendance. In a conference call, with the developer, late this afternoon the developer has decided not to address the public this evening. There will be a town meeting held at a later date. Residents will be notified.

 

Mr. Kearney   A concern is hearing criticism from the public, by council, prior to hearing the application, could bias Council's decision. It is certainly important for the Governing Body to have input from the community but it would be more productive if it came after the developer's presentation. Opinions voiced now could be counter-productive. Request an address list from everyone present.

 

Mayor Costantino stated again that the developer wishes to hold a town meeting to answer any questions. Encourages all to attend the town meeting – many rumors that he is hearing are not based on fact.

 

Mr. Spencer and Mr. James voiced their irritation at the developer for not appearing at the meeting. They feel it is an imposition on the residents who, in some cases, had to change their schedules to be here tonight.

 

Mayor Costantino called for a five minute recess.

Motion to pay all bills found true and correct, as certified by the CFO, as to the availability of funds, for the bill list of April 21, 2008 meeting made by Mr. Green, seconded by Mr. Warrington. On roll call vote motion carried.

Hickstown Road . (CANCELLED).

 

1.   ORDINANCE/S:

 

2008-814   An Ordinance Appropriating the Sum of $170,000.00 to be Used for

Reconstruction of East Clearview Avenue Within the Borough of Pine Hill, County of Camden , State of New Jersey . (Public Hearing 05/19/08 ).

 

Motion to introduce Ordinance 2008-814 made by Mr. Warrington, seconded by Mrs. McCullen. On roll call vote motion carried.   

 

2. RESOLUTIONS:

 

2008-61   Authorize the Proper Officials to Execute the Agreement with the Governor's Council on Alcoholism and Drug Abuse. ($11,261.00)

2008-61   BE IT RESOLVED by the governing body of the Borough of Pine Hill, County of Camden that the proper officials be and are hereby authorize to execute and seal the agreement between the county of Camden and the Borough of Pine Hill for the Governor's Council on Alcoholism and Drug Abuse grant of $11,261.00.

 

 

2008-62   Authorize the Proper Officials to Execute a Three Year Cooperation Agreement with the County of Camden (CCCDBG) Years 31, 32 & 33.

 

WHEREAS, the Borough of Pine Hill and the County of Camden wish to establish a cooperative means of conducting certain eligible community development and affordable housing activities; and

 

WHEREAS, title 1 of the Housing and Community Development Act of 1974, and the HOME Program Act of 1991, as amended, provides federal funds being made available to Camden County for use to carry out eligible Community Development Activities therein; and

 

WHEREAS, the Interlocal Services Act (N.J.S.A. 40:8A-1 et seq. As amended, provides a mechanism through which counties and municipalities may enter into agreements for the provisions of joint services; and

 

WHEREAS, the Borough of Pine Hill will propose certain activities to be carried out under the 31, 32, 33 rd Year Community Development and HOME Programs; and

 

WHEREAS, the aforesaid activities are in the best interest of the Borough of Pine Hill;

 

NOW, THEREFORE, BE IT RESOLVED , by the Governing Body of the Borough of Pine Hill that the 31, 32, 33 rd Year Cooperation Agreement be adopted.

 

BE IT FURTHER RESOVED, that this resolution shall take effect immediately upon its enactment as provided by law.

 

2008-63   Authorize the Proper Officials to sign the Project Description Form for Program Year 30 (CCCDBG - 2008-2009). (Adopted - See meeting of 04/14/2008 )

 

 

2008-64   Taxes:     Senior Citizen Deduction

 

BE IT RESOLVED , by the governing body of the Borough of Pine Hill, pursuant to the advise of the Borough Tax Collector Diana M. May, the following adjustments are hereby authorized:

 

 

•  Grant a $250.00 Senior Citizen Deduction on 2008 taxes to Michael & Ruth
Yaworski, 55 E. Woodburn Avenue . Block 47, Lot 14.

 

 

2008-65   Taxes:     Disabled Citizen Deduction

 

BE IT RESOLVED , by the governing body of the Borough of Pine Hill, pursuant to the advise of the Borough Tax Collector Diana M. May, the following adjustments are hereby authorized:

 

 

•  Grant a $250.00 Disabled Deduction on 2008 taxes to Robert Piot,
58 E. Clearview Avenue . Block 47, Lot 25.

 

 

2008-66   Taxes:     Veteran's Deduction

 

BE IT RESOLVED , by the governing body of the Borough of Pine Hill, pursuant to the advise of the Borough Tax Collector Diana M. May, the following adjustments are hereby authorized:

 

 

•  Grant a $250.00 Veteran Deduction on 2008 taxes to Marion Stokes.

2008-67   Emergency Temporary Budget NJS 40A:4-20

 

 

 

 

 

 

 

 

 

 

 

WHEREAS, an emergency condition has arisen with respect to the

 

need to provide budgetary funds for 2008; and

 

 

 

 

 

 

 

 

 

 

 

 

 

WHEREAS, the cause of the emergency is due to the that the Borough

 

is unable to adopt the 2008 annual budget without proper revenue figures

 

and State approval; and

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

WHEREAS, it is considered necessary for the health and welfare of

 

the community to continue to provide necessary services;

 

 

 

 

 

 

 

 

 

 

 

 

NOW, THEREFORE, BE IT RESOLVED (not less than two-thirds of all

 

the members thereof affirmatively concurring) that in accordance with NJS

2008-68   Temporary Capital Budget

 

 

  WHEREAS, the need has arisen to introduce various capital ordinances to provide funds for various capital improvements prior to adoption of the 2008 Capital Budget, and;

  WHEREAS, the regulations of the Local Finance Board (N.J.A.C. 5:30-4.3(b)) of the Division of Local Government Services, Department of Community Affairs requires that a municipality adopt a temporary capital budget if a capital ordinance is to be passed prior to adoption of the Annual Capital Budget,

 

  NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the Borough of Pine Hill, County of Camden that:

 

  Section 1.   2008 Temporary Capital Budget is hereby created for the following:

 

      Reconstruction of East Clearview Avenue       $170,000.00           

 

  Section 2.   The projects will be included in the adopted 2008 Capital Budget, and

 

  Section 3.   One certified copy shall be forwarded to the Director of the Division of Local Government Services immediately after passage.

 

2008-69   Award Remington & Vernick Contract to Prepare Revisions to the Borough Tax Maps (Ordinance 2008-812 $33,410.00)

 

2008-69 BE IT RESOLVED, By the governing body of the Borough of Pine Hill, County of Camden, State of New Jersey that PAUL KELLY of Remington & Vernick be and is hereby awarded the contract for Revisions to the Borough Tax Maps and any administrative services associated with said project, not to exceed $33,410.00.

14.   PUBLIC DISCUSSION:

 

Mayor Costantino opened the floor to the public.

 

Felicia Stokes – Bromley Estates – Several concerns. One regarding Lake & Forrester Avenues, pot holes, road uneven, water, etc. Mayor agrees. Is there a schedule or plan for these two roads? Mr. Kearney replied Forrester Avenue not a dedicated road. The developer is in bankruptcy. The borough has a lawsuit pending against the bonding companies to have this paid for. We hope to receive permission from the court to put this work out for bid and have the bonding company pay for it. It is unfortunate that it has taken so long to get this far. Mrs. Stokes also had questions concerning Ski Mountain Drive – what is the status of this road? Mr. Green said this also is not a dedicated road, it belongs to Bromley Estates. Ms. Stokes questioned what needs to be done for the Borough to take over this road? Mr. Kearney replied that until the road can be brought up to Borough standards nothing can be done. Mr. Kelly, our engineer, will provide Ms. Stokes with the standards for the roads.

 

Mr. Charles Dains – 121 East 11 th Avenue – Sitting with Mike Piazza ex-Mayor. Feels all residents should be notified when there is a development change as it affects everyone. Mayor explained that to notify everyone would be costly. We satisfied the law by noticing residents within 200'. He also stated that the Minutes and Agendas will be on the web page. Public Notices are published in the Record Breeze and sometimes in the Courier Post. Often there are last minute changes to our Agenda. Mr. Daines suggested when there is a special issue to put the information on the sign at Veteran's Park..

 

Ms. June Wickizer – 1620 Lake Avenue – Traffic Concerns on Lake Avenue . Cars traveling very fast. Children must stay in their yards. Afraid for her grandchildren.

Chief Cheeseman will address the issue.

 

Jennifer Wickizer – 27 West Hickstown Road – June Wickizer is her Grandmother and she totally agrees with her on the traffic question.

 

Mr. Spencer –1036 Crest Road – Has a problem with the basketball nets in the streets. Mayor Costantino said that this has come before council in the past and the residents do not want an Ordinance prohibiting the nets.

 

Natalie Maguire – East 9 th Avenue – Agrees with Mr. Spencer about the basketball nets in the street.

Motion to close the floor to the public made by Warrington , seconded by Mr. McGlinchey. On voice vote motion carried.

 

15.   COUNCIL REPORTS:

 

 

Mr. McGlinchey   No Report

 

Mr. Green     Since the properties, that the Borough was selling, were denied approval at the Planning Board meeting we will be $180,000.00 short in our projected budget. All should look at their departments and determine any cuts that can be made. Mr. Cardis made the point that we will need to tap into our surplus funds. The properties not sold. Applying for extraordinary aid is complicated – many items looked at. It is the Borough's responsibility to prove point. Explained the process.

 

Mayor Costantino   Payroll Clerk leaving the end of May. Possibility of shared services.

 

Mr. McGlinchey   Questioned if the parties involved with the sale of property
