The minutes of a regular meeting of the Borough of Pine Hill, County of Camden , State of New Jersey , held on March 17, 2008 . The meeting was called to order by
Mayor Costantino at 7:30pm , followed by the Pledge of Allegiance.
The clerk stated that the notice requirements provided for in the “Open Public Meetings Act” have been satisfied. Notice was properly given and transmitted to the Record Breeze, Blackwood, New Jersey and the Courier Post Newspaper, Cherry Hill, New Jersey, posted on the bulletin board in the Borough Hall and on file with the Borough Clerk of the Borough of Pine Hill all on January 8, 2008.

GUESTS: Mrs. McCullen introduced James Malin, Troop 122, wants to be an Eagle Scout. He is proposing to redo Freedom Triangle, by adding benches, walkways, new plants, etc.., Planning to start early in April.

PROCLAMATION
ALCOHOL AWARENESS MONTH
WHEREAS , alcohol is a factor in the four leading causes of death among persons ages 10-24: motor-vehicle crashes, unintentional injuries, homicide and suicide: and
WHEREAS , approximately 9.7 million current drinkers in the United States are between the ages of 12-20; and
WHEREAS, alcohol is the most frequently used drug by high school seniors; and
WHEREAS , young people begin drinking, on average, at 13.1 years of age; and
WHEREAS , young people who begin drinking before age 15 are four times more likely to develop alcohol dependences than those who begin drinking at age 21; and
WHEREAS , alcohol abuse is linked to as many as two-thirds of all sexual assaults and date rapes of teens and college students and is a major factor in unprotected sex among youth, increasing their risk of contracting HIV or other transmitted diseases; and
WHEREAS, the typical American young person will see 100,000 beer commercials before he or she turns 18 (that is more than for sneakers, gum and jeans);
WHEREAS , 13 percent of all youth, ages 12-17, had at least one serious problem related to drinking in the past year,
NOW, THEREFORE , I, Mayor Fred Costantino, do hereby proclaim that April 2004 is Alcohol Awareness Month in the Borough of Pine Hill. As Mayor I also call upon all citizens, parents, governmental agencies, public and private institutions, businesses, hospitals and schools in the Borough of Pine Hill to support efforts that will encourage recovery throughout our community.

2008-52 Special Emergency Appropriation Resolution
BOROUGH OF PINE HILL
COUNTY OF CAMDEN
RESOLUTION NO. 2008-52
SPECIAL EMERGENY RESOLUTION – 40:4-53
W HEREAS, it has been found necessary to make an Emergency Appropriation to meet certain extraordinary expenses incurred, or to be incurred, by reason to fund the 2008 Emergency Appropriation for revisions to the tax maps and,
WHEREAS, NJS 40:4-53 provides that it shall be lawful to make such appropriation, which appropriation and/or the “special emergency notes” issued to finance the same shall be provided for in succeeding annual budgets by the inclusion of an appropriation of at least one-fifth of the amount authorized pursuant to this act.
NOW, THEREFORE BE IT RESOLVED (not less than two-thirds of all governing body members affirmatively concurring) that in accordance with the provisions of NJS 40:4-53;
1. An Emergency Appropriation is hereby made for 2008 Emergency Appropriation in the total amount of $42,000.00.
2. That the Emergency Appropriation shall be provided for in the budgets of the next succeeding years by the inclusion of not less than $8400.00 in each of the next five succeeding annual budgets, starting with the year 2009.
3. That an “emergency note”, not in excess of the amount authorized pursuant to the law, be provided.
4. That such note shall be executed by Thomas Cardis, Chief Financial Officer.
5. That said note be dated (to be determined), may be renewed from time to time provided that such note and any renewals shall mature and be paid in the amount of not less than one-fifth of the total amount appropriated by this resolution in each year after the authorization.
6. That the statement required by the local Finance Board has been filed with the Clerk and a copy will be transmitted to the Director of the Division of Local Government Services.
7. That two certified copies of this resolution will be filed with the Director of the Division of Local Government Services.
2008-53 Resolution Opposing the Failure of the Governor's Proposed State Budget for the 2008-2009 Fiscal Year to Treat Property Tax Relief as our Priority
WHEREAS , on February 26, 2008, in Trenton, Governor Jon S. Corzine presented his FY 2009 Budget proposal to a Joint Session of the State Legislature, which proposal now goes to the Legislature, which must pass a balanced budget by the start of the State's next Fiscal Year, which begins on July 1; and
WHEREAS , the proposal, which represents what the Governor called "many unpleasant choices," calls for the elimination of two Departments of State Government (the Departments of Agriculture and Personnel) and the State Commerce Commission, and asks all other Departments to absorb funding cuts, and further calls for sacrifice in a number of other areas, including direct property tax relief, hospital aid, higher education assistance and Medicaid, with the inordinately deep cuts in municipal property tax relief funding; and
WHEREAS , one year after the historic Special Session for Property Tax Reform, which purportedly eliminated the need for a Citizens' Convention, our property taxpayers will once again be asked for patience, and they will be asked to shoulder more than their fair share of the funding burden; and
WHEREAS , local officials have done so much with so little for so long, that State Budget makers now believe some can do everything with absolutely nothing; and
WHEREAS , municipal property tax relief will be slashed by $189.6 million; and
WHEREAS , for municipalities with a population of less than 5,000, there will be no CMPTRA funding this year; for municipalities with a population total between 5,000 and 10,000, this relief will be limited to one-half of the amount received in the State's 2006-2007 budget; and the $32.6 million distributed according to the CMPTRA formula, which municipalities received last year as 2008 Municipal Property Tax Assistance, is gone; and
WHEREAS , all municipalities will receive level Energy Tax Receipts Property Tax Relief funding, despite State Law that 'requires' annual inflationary adjustments of this (and CMPTRA) funding; and
WHEREAS, last year, municipal efficiency was promoted to the tune of $34.8 million, but in this proposal, this funding has been eliminated; and
WHEREAS , last year's $32 million in Municipal Homeland Security Funding is gone, Special Municipal Aid funding is cut from $153 million to $145.4 -a loss of$7.6 million, Extraordinary Aid funding is reduced by $1.7 million -from $34 million to $32.3 million, and the $8 million Regional Efficiency Aid Program will not be funded; and
WHEREAS, beyond these cuts, certain municipalities served by the State Police will be asked to contribute $20 million to the State's General Fund, and Homestead Rebates for Homeowners will be cut by $257 million, and for Renters by $124 million; and
WHEREAS, this negatively impacts our taxpayers, now, therefore, be it
RESOLVED , that the governing body of the borough of Pine Hill calls on its elected representatives in Trenton, Senator and Assembly members, to work with their colleagues in the Legislature and with the Governor to take affirmative action to restore program funding sufficient to honor state statutes and their stated commitment to the cause of property tax relief in all New Jersey municipalities; and be it further
RESOLVED , that copies of this resolution be forwarded to Governor Jon S. Corzine, Acting State Treasurer R. David Rousseau, Senate President Richard J. Codey, Senate Minority Leader Thomas H. Kean, Assembly Speaker Joseph 1. Roberts, Assembly Minority Leader Alex DeCroce, the Chairs and Members of the Senate and Assembly Budget and Appropriations Committees, our own Senator and Assembly members and to the New Jersey State League of Municipalities.
2008-54 WaWa Store #362 917 Erial Road - Maintenance Bond Release
2008-54 WHEREAS , WaWa, Inc, has requested a maintenance bond release in Traveler's Casualty and Surety Company of America , Maintenance bond number 104368613 in the amount of $17,193.15, representing 15% of the Construction cost to be held for a period of two (2) year.
WHEREAS , the Borough Engineer has given his recommendation; and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of
The Borough of Pine Hill, County of Camden , State of New Jersey that release of the two (2) year bond for WaWa, Inc. is approved according to the recommendation of the Borough Engineer.
2008-55 Authorize the Proper Officials to Sign to Sign the Community Work Experience Program (CWEP) Agreement in Conjunction with the New Jersey Department of Labor and Workforce Development and ( Paris )

2008-58 Waive Construction (Electrical) Fees for the Pine Hill MUA Pump Station 13 Cross Road – West Branch Avenue
BE IT RESOLVED by the Governing Body of the Borough of Pine Hill that the fees for the electrical sub-code work at the Pine Hill MUA Pump Station – 13 Cross Road & West Branch Avenue , are hereby waived.
2008-59 Opposing S-770 and A-1645 Mandating the Appointment of a Qualified Purchasing Agent and the Attendant Reorganization of the Borough of Pine Hill's Purchasing Functions.
WHEREAS , Pine hill strongly supports the employment of the best purchasing practices to not only ensure compliance with the numerous state statues governing public procurement but also to obtain the most favorable pricing for required services and products; and
WHEREAS , Pine Hill encourages and allows its employees to receive continuing education courses and frequent training to remain relevant of new statues, changes in regulations and best practice procedures which encourage proper cost effective purchasing; and
WHEREAS , the Legislature has before it bills, S-770 and A-1645, endorsed by the Purchasing Officials and no other statewide local government organization that would significantly impact on the operation of the purchasing function by requiring the
Reorganization of the purchasing function into a separate office not under the direct supervision of the local unit's administrator, manager, CFO and other officials; and
WHEREAS , Pine Hill has not experienced any challenges or crisis in purchasing procedures that warrants imposing this unfunded mandate upon local governments and questions what existing problem (s ) it purports to fix; and
WHEREAS , Pine Hill takes exception to this unfunded state mandate which represents an intrusion into the management prerogatives of local officials to organize purchasing functions that are in the best interest of resident taxpayers; and
WHEREAS , S-770 and A1645 will not reduce the cost of municipal operation nor lead to better purchasing activities; rather these unfunded mandates will, in all probability, lead to higher purchasing costs in the future given the mandates contained therein; and
WHEREAS , it is unconscionable for the Legislature to impose another unfunded mandate during a time when Mayors and governing body members are focused on proposed budget cuts that will result in increased property taxes and the curtailment of services to residents.
NOW, THEREFORE, BE IT RESOLVED , that the governing body of the Borough of Pine Hill in the County of Camden
1. Opposes S-770 and its companion bill A-1645 as an unfunded state mandate with no new or additional capabilities to assist towns in improving purchasing activities and in all probability will lead to future cost increases.
2. Opposes S-770 and its companion bill A-1645 which change an existing option afforded local units into a mandate to appoint a qualified purchasing agent.
3. Certified copies of this resolution be forwarded to Governor Jon Corzine, Senator John Adler, State Assembly Representative Robert Andrews, and the NJ League of Municipalities
2008-60 Authorize the Proper Officials to Execute the Contract for Trash and Recyclables awarded to Frank Kull, Inc.
Be it resolved by the Governing Body of the borough of Pine Hill that the Proper Officials are hereby authorized to Execute the Contract for Trash and Recyclables awarded to Frank Kull, Inc.

COUNCIL REPORTS:
Mr. McGlinchey Reported that Mr. Buchanan is ill again. Any questions please
call Mr. LaBree or the Mayor.
Mr. Green No Report – Mayor Costantino complimented Mr. Green on his work with the budget and said he will attend a meeting with the Mayors, Legislators and possibly the press to discuss the negative impact of the Governor's proposed budget on the municipalities. The financial impact, at this time for Pine Hill is relatively minor in comparison to some other towns.
Mrs. McCullen Submitted the Environmental Commission Minutes from the last meeting. Will begin the Yards of the Month in the spring. Will be preparing for the Anti-Litter program with the school children. Mayor Costantino complimented Mrs. McCullen for her participation in the various programs.
Mr. Como Parade for baseball April 19, 2008 at 9:30am – everyone is invited. The Easter Egg Hunt March 22, 2008 . Anyone wishing to donate a basket it will be appreciated.
Mr. Warrington Discussed the Police Department Report. Addressed the issue of the property revaluation. The Mayor and Mr. Cardis explained that the Revaluation is mandated.
Mr. DelRossi A Scout master for a number of years and must say that it is an accomplishment for any young man to attain Eagle Scout. Wishes to discuss the placement of clothing bins within the Borough over the next few weeks. Also, think about how we can make the Borough “Green”, low energy light bulbs, ballasts, etc.
Mayor Costantino Received an invitation to Alcohol and Drug Awareness breakfast, If anyone wishes to attend the date is Friday April 4, 2008 .
Mr. Warrington Addressed a resident's problem concerning drainage.
