The minutes of the 79 th re-organization meeting and the Workshop Business Meeting of the Borough Council of the Borough of Pine Hill, County of Camden , State of New Jersey , held January 7, 2008 . The meeting was called to order by Mayor Fred Costantino at 6:07pm , followed by the Pledge of Allegiance led by Chief Cheeseman.
National Anthem - sung by Samantha Thurston a junior at Overbrook Senior High School .
All South Jersey Chorus and All State Women's Chorus. Mayor Costantino presented Ms. Thurston with a Certificate of Appreciation.
Bob Riconda, Pastor Hope Chapel, led the guests in Prayer.
Mr. Kearney swore in Loretta Buchanan as Acting Municipal Clerk

REMARKS OF NEWLY INSTALLED COUNCILMAN:
Mr. Warrington Thanked his family (wife, sons and parents) for allowing him time to devote to Council. Thanked Council members and the Democrat Club for their support. Also, grateful to the voters of Pine Hill.
Mr. DelRossi Thanked his family, Council, Chief Cheeseman, Mr. Malissa, Mr. Cardis
and the Democrat Club for their help and support. Feels the Borough is moving forward. Spoke of the greenhouse effect, use more efficient energy sources. Pine Hill, Home for a Lifetime.
REMARKS BY MAYOR COSTANTINO:
Mayor Costantino Thanked the voters. The last four years have been difficult. He thanked Mr. Kearney, Mr. Cardis, Bowman & Associates and Mr. Malissa for their help in obtaining grant monies used for Borough improvements. New equipment purchased, new Public Works Building. Sold two buildings for a total of $188,000.00. Average local tax increase 3%, less than the cost of living. Mayor and Council committed to moving forward, keeping costs down.
Thanked Mr. Green and the Democrat Club and wife Nancy.

ARTICLE IX . Specific duties and responsibilities of governing body members of, borough employees and professionals are detailed in Appendix "A" to the rules of Council. The Borough Administrator, in collaboration with the Borough Clerk is responsible for ensuring that the caucus outline, regular and special meeting agendas and reports are prepared prior to each meeting with all concomitant documentation (Ordinances, Resolutions, etc.) in place to allow Mayor and Council sufficient time to review.
ARTICLE X. In case of failure of the Director of any department to act because of absence, sickness or neglect, the duties of the Director will devolve upon the Deputy member of the standing committee. In the event, of a resignation of any standing committee Director, the vacancy will be filled by the Deputy Director. Standing Committees are appointed by the Mayor, with the advice and consent of Council. A standing committee shall: 1. Plan, study, direct, make commitments within budgetary limitations. 2. Perform such acts as assigned to it by Mayor and Council. 3. Report and make recommendations to the Mayor and Council regarding operations for the department(s) for which the committee is responsible. A standing committee shall not: 1.
Exceed its budgetary appropriations without the approval of Mayor and Council. 2. Make promises or commitments to anyone directly, or by inference, bind the Mayor and Council.
The Director of each standing committee shall, report to the Mayor and Council at each regular meeting on the activities and achievements of the committee.
ARTICLE XI . All ordinances shall be presented to the Mayor and Council three days in advance of introduction and they shall be adopted in accordance with N.J.S.A 40:49-2.
ARTICLE XII . All reports, resolutions, ordinances shall be read by the Mayor or the borough clerk. A copy of the statistical reports or departments shall be given to Mayor and Council prior to each regular meeting. The Borough Clerk shall only provide summary totals, with the detailed report incorporated in the minutes.
ARTICLE XIII : The Mayor may grant the privilege of the floor to any person desiring to address the governing body during the good and welfare portion of the meeting. This privilege will be granted with the understanding that any comments made shall be made with the general welfare of the Borough in mind. The Mayor or person chairing the meeting may limit discussion of each speaker to five (5) minutes. Personal accusations and derogatory remarks will be considered out of order.
ARTICLE XIV : The consent of a majority of the Mayor and Council shall be required to suspend, repeal, amend or supplement any of the rules contained herein.
ARTICLE XV : The rules of parliamentary practice, as set forth in the Roberts Rules of Order shall govern in all cases when there is a disparity between the rules and establish parliamentary procedure.

2008-5 WHEREAS , P.L. 1989, c. 51 enables municipalities in the State of New Jersey to establish Municipal Alliance Committees, the objective of which are to identify community needs concerning alcohol and drug problems, develop alcohol and drug prevention programs, to provide community education and to implement the programs formulated by the Municipal Alliance Committees; and
WHEREAS , P.L. 1989 c. 51 provides for the distribution of grants from the drug enforcement and demand reduction fund (N.J.S. 2C: 35-15) to Municipal Alliance Committees to carry out the aforesaid objectives; and
WHEREAS , said monies would increase the scope of programs and services available to the youth and families of the Borough of Pine Hill;

2008-7 WHEREAS, it is the desire of the governing body of the Borough Of Pine Hill to provide a clean litter-free environment for its citizens; and
WHEREAS, the municipality of the Borough Of Pine Hill is eligible to receive and annual grant under the Clean Communities Act (N.J.S.A. 13:1e-99.1 et seq., as amended by P.L. 1989, c.108 and P.L.1992 c.150), as administered by the New Jersey Department of Environmental Protection, to create or to supplement an existing litter reduction program within the municipality; and
WHEREAS, to be eligible for this funding the governing body of the Borough Of Pine Hill must adopt a model program for litter control as required by N.J.S.A. 13:1E-99.2e, and must certify that the model program has been adopted;
NOW, THEREFORE, BE IT RESOLVED , by the governing body of the municipality of the Borough Of Pine Hill: that Councilman Chris Como and/or Councilman Charles Warrington , is hereby authorized to apply to the New Jersey Department of Environmental Protection and execute all documents necessary for a grant in an amount to be determined by the State; that, if any additional Clean Communities funding is awarded, all such additional funding will be used only on a program of litter reduction in accordance with the grant requirements and with all other conditions of this application;
BE IT FURTHER RESOLVED that the Borough Of Pine Hill will be responsible for the Clean Communities program implementation, and Councilman Chris Como and Councilman Charles Warrington is hereby designated as the Clean Community coordinators.

WHEREAS, this Emergency Operations Plan sets forth the general policies and procedures to be carried out by municipal and volunteer entities in order to provide the citizens of the Borough with an effective integrated emergency response plan designed to minimize the loss of life and property during an emergency; and

2008-11 WHEREAS , there is hereby established an annual requirement of a Municipality to appoint a voting representative and alternate to the Camden County Community Development Board of Directors; and
WHEREAS , the Borough of Pine Hill wishes to continue to be a voting member of said Board in conjunction with the existing Cooperation Agreement;
NOW, THEREFORE, BE IT RESOLVED by the Borough of Pine Hill to that Mayor Fred Costantino is hereby appointed to serve as the representative from the Borough of Pine Hill to the Camden County Community Development Board of Directors; and
FURTHER, Mayor Fred Costantino is hereby appointed to serve as the alternate member,
FURTHER , a certified copy of this Resolution is to be submitted to the County Office of Community Development.

2008-14 BE IT RESOLVED by the governing body of the Borough of Pine Hill, County of Camden, State of New Jersey that the following be and is hereby appointed to the Economic Development Commission:

2008-15 WHEREAS , the Mandatory Source Separation and Recycling Act, P.L.1987, c.102 has established a recycling fund from which tonnage grant may be made to municipalities in order to encourage local source separation and recycling programs; and
WHEREAS , it is the intent and the spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grants to develop new municipal recycling programs and to continue and to expand existing programs; and
WHEREAS , the New Jersey Department of Environmental Protection has promulgated recycling regulations to implement the Mandatory Source Separation and Recycling Act; and
WHEREAS , the recycling regulations impose on municipalities certain requirements as a condition for applying for tonnage grants, including but not limited to, making and keeping accurate, verifiable records of materials collected and claimed by the municipality; and
WHEREAS , a resolution authorizing this municipality to apply for such tonnage grants, for the calendar year 2007 and will memorialize the commitment of this municipality to recycling and to indicate the assent of the Borough of Pine Hill to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations; and
WHEREAS , such a resolution should designate the individual authorized to ensure the application is properly completed and timely filed.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Pine Hill that the Borough of Pine Hill hereby endorses the submission of the recycling tonnage grant application to the New Jersey Department of Environmental Protection and designates Councilwoman Ruth McCullen to ensure that the application is properly filed; and
BE IT FURTHER RESOLVED that the monies received from the recycling tonnage grant be deposited in a dedicated recycling trust fund to be used solely for the purpose of recycling.

WHEREAS, an emergency condition has arisen with respect to the |

need to provide budgetary funds for 2008; and |

WHEREAS, the cause of the emergency is due to the that the Borough |

is unable to adopt the 2008 annual budget without proper revenue figures |
||||||||
and State approval; and |

WHEREAS, it is considered necessary for the health and welfare of |
|||||||
the community to continue to provide necessary services; |
