3. Each party bears the operating and maintenance costs of services and facilities covered in paragraph 1 of this article, which it uses exclusively, as well as the identifiable direct costs associated with the use of shared basic general facilities and services. The overall costs of using and maintaining shared facilities and basic general services are allocated by both parties based on the service provided for each party. The parties enter into written cost allocation agreements, which are subject to the approval of the standing committee. 3. In accordance with Article 2, paragraph 2 of this agreement, appropriate arrangements are made by mutual agreement between the United States Navy authorities and the Spanish Navy regarding the safety of submarine navigation. The State Department extends its compliments to the U.S. Embassy and has the honor of confirming the receipt of Verbal Note Number 146 and confirming its content agreement. The purpose of this Memorandum of Understanding is to confirm the buyer`s interest and willingness to continue to negotiate an international sales contract which, due to volume or complexity, requires a certain amount of time to reach an agreement. It can also be used to define the terms and conditions of the contract and take into account the progress of the negotiations. The lack of agreement between the Spanish Ministry of Defence and representatives of local staff should not be the subject of an arbitration or judgment decision.
A written agreement will be reached between the two governments before being allocated to the work, in accordance with the interest of the various parties at work, the contribution of the two governments to their costs and the contribution of the two governments approved by the Standing Committee. These projects are jointly established and approved and the technical staff of the U.S. Armed Forces are effectively involved in monitoring and receiving the work. Any difference of opinion within the Joint Technical Committee is brought to the attention of the Standing Committee for decision. (Note: the amendment protocols provide that the contracting parties may, if necessary, enter into administrative arrangements and arrangements for the implementation of the amendment protocols, provided that these agreements and arrangements are in accordance with the respective agreement and national legislation of the contracting parties.
